I am aware that the digital services and online courses offered by Johanna Thanheiser / Equisensomotoric® are intended for knowledgeable, advanced riders and that handling and riding horses involves risks. I understand that I implement exercises, instructions, and training methods solely on my own responsibility and only after personally assessing the specific situation.

    1. Scope of Application

    3. Subject Matter of the Contract

The subject matter of this contract is the provision of the digital services described in the respective offer. These may include, in particular: access to online courses, digital teaching and support materials, online lessons, training tips in the forum, comment functions, and video feedback.

No specific training, learning, or practical success is guaranteed.

    4. Conclusion of Contract

By clicking the checkbox, I confirm that I have read the Terms and Conditions. The contract is concluded upon completion of the electronic ordering process.

    5. Payment Processing

Payment processing for digital online products is handled by the third-party provider Ablefy. Ablefy's terms and conditions also apply to the payment process and the payment methods offered there. Payment for online lessons is processed via invoice issued by Johanna Thanheiser.

    6. Personal Use and Access Data

Access to the online course account is strictly personal and non-transferable. Access data must not be shared with third parties.

The provided content is intended solely for your personal use. Sharing, duplicating, or publicly making available paid content, videos, materials, or access data is prohibited.

    7. Target Audience and Personal Responsibility

The content offered is not intended for beginners in equestrian sports, but rather for experienced and knowledgeable riders or trainers with advanced skills in handling horses, risk assessment, and practical training.

All exercises, instructions, training methods, and techniques must be independently assessed for suitability, safety, and feasibility by the individual involved. The specific risk situation can only be assessed by the person actually working with, holding, or riding the horse.

Exercises should be avoided if the specific situation, the training level of the rider or horse, the horse's health, or other circumstances preclude their execution.

Particular caution is required with training methods such as liberty work, work without a halter, bitless riding, and riding with a neck ring. These forms of handling and riding the horse involve an increased risk because the ability to directly influence and control the horse may be limited in individual cases.

Such exercises and training methods should only be performed by advanced, knowledgeable riders and only with horses that the person present has assessed as suitable based on their training level, temperament, behavior, and current condition.

These exercises should only be conducted in fenced, secure areas and only with appropriate safety precautions, such as wearing a bridle in addition to the neck ring when riding with a neck ring. If local conditions, the horse's behavior, the training level of the person or horse, or other circumstances give rise to doubts about the safe execution of these exercises, they must be omitted. The assessment of the specific hazards and the necessary safety measures is the sole responsibility of the person on site.

    8. No Substitute for Professional On-Site Assessment

The information provided on the website, in online courses, online lessons, the forum, or other materials does not replace an individual assessment of the specific situation on-site.

In particular, the content does not replace a veterinary, therapeutic, or other expert examination or treatment. In the event of health or functional problems with the horse, a veterinarian or a suitably qualified professional must be consulted.

    9. Nature of Services

The training content, downloadable documents, instructions, and feedback offered serve to impart knowledge and provide individual guidance within the scope of the respective product booked. They do not claim to be comprehensive for all conceivable problems or suitable for every specific stable, training, or horse situation.

Insofar as services are provided in the forum or through video feedback, these are based on the information and materials provided by the participant.

To the extent that services are provided in the forum or through video feedback, they are based on the information and materials provided by the participant.

    10. Online Lessons, Forum, and Training Tips

If online lessons, forums, or training tips are part of the booked product, these services are provided exclusively within the scope of the respective offer and its technical capabilities.

Comments, comments, and feedback in the forum or online lessons are based on information provided by the participant and do not replace an assessment of the specific situation on-site. Practical implementation is solely the responsibility of the participant.

    11. Video Feedback for Annual Subscription Courses

If video feedback is included in the respective annual subscription or digital product, videos can only be submitted via a YouTube or Vimeo link in the designated forum.

There is no entitlement to comment on videos or files sent via cloud providers, messenger services, or other transmission methods.

A total of up to 100 minutes of video material can be submitted for comment per annual subscription period. There is no entitlement to comment beyond this limit.

    12. Changes to the Scope of Services

For each current contract period, the scope of services described at the time of contract conclusion applies for one subscription year.

We reserve the right to make changes for future contract periods, and any such changes will be clearly and comprehensibly communicated before contract renewal.

    13. Copyright

All content of the website, online courses, and other digital services, in particular texts, comments, suggestions, ideas, notes, drawings, concepts, graphics, videos, photos, and other materials, are protected by copyright and remain the property of Johanna Thanheiser / Equisensomotoric®.

The content may only be used within the scope of the contractually granted personal right of use. Transfer to third parties, publication, editing, or commercial use is prohibited without express written consent.

    14. No Automatic Licensing or Certification

Participation in an online course, annual subscription, or a lesson does not automatically lead to official licensing or certification as an Equisensomotoric® trainer.

Any licensing that may be required is governed exclusively by separate terms and conditions. Participation in the course therefore does not entitle participants to publicly present themselves as licensed or certified Equisensomotoric® trainers unless explicitly authorized to do so.

    15. Public Image and Advertising

Participants may not advertise themselves as official certified or licensed Equisensomotoric® trainers unless explicitly authorized to do so. Any mention of course participation by participants must be truthful and without misleading representation.

    16. Code of Conduct and Exclusion

Participants must use the provided communication channels, particularly the forum, in a professional and respectful manner.

In cases of serious violations of these Terms and Conditions, the Equisensomotoric Training Principles, misuse of the forum, sharing of access data, or unauthorized distribution of content, access to interactive features or digital services may be restricted or blocked.

    17. Liability

The practical implementation of all training content, exercises, instructions, and feedback is the sole responsibility of the individual participant on site. This individual is responsible for assessing the specific situation, the horse's behavior, its training level, the local conditions, and any potential risks.

Johanna Thanheiser / Equisensomotoric® makes no guarantee that general training instructions are suitable, safe, or successfully applicable in every individual situation. Liability for damages arising solely from the implementation of general instructions without independently assessing the specific situation on site is excluded only to the extent permitted by law.

In online lessons, the client is obligated to ensure a safe environment (e.g., a fenced riding arena, appropriate and safe equipment, wearing a riding helmet) and to assess potential hazards on site, as well as the horse's condition and training level. Johanna Thanheiser / Equisensomotoric® accepts no liability for accidents or damages resulting from technical malfunctions (e.g., connection interruptions, delayed video/audio transmission) and any resulting delays or misunderstandings in instructions.

    18. Availability of Digital Services

Digital services are provided within the scope of available technical and organizational resources. Temporary limitations or interruptions may occur, particularly for technical reasons.

    19. Language and Provision of the Terms and Conditions

These Terms and Conditions are provided in German.

    20. Clarity of the Terms and Conditions

These Terms and Conditions are structured and divided into individual sections.

    21. Severability Clause

Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
